We don’t collect, read or store your personal SMS from your inbox. We collect and monitor only financial SMS sent by 6-digit alphanumeric senders from your inbox which helps us in identifying the various bank accounts that you may be holding, cash flow patterns, description, and amount of the transactions undertaken by you as a user to help us perform a credit risk assessment which enables us to determine your risk profile and to provide you with the appropriate credit analysis. This process will enable you to take financial facilities from the regulated financial entities available on the Platform. This Financial SMS data also includes your historical data.

COLLECTION OF DEVICE LOCATION AND DEVICE INFORMATION

We collect and monitor the information about the location of your device to provide serviceability of your loan application, to reduce the risk associated with your loan application, and provide pre-approved customized loan offers. This also helps us to verify the address, make a better credit risk decision and expedite the know your customer (KYC) process. Information the App collects, and its usage depends on how you manage your privacy controls on your device. When you install the App, we store the information we collect with unique identifiers tied to the device you are using. We collect information from the device when you download and install the App and explicitly seek permissions from You to get the required information from the device. The information we collect from your device includes the hardware model, build model, RAM, storage; unique device identifiers like IMEI, serial number, SSAID; SIM information that includes network operator, roaming state, MNC and MCC codes, WIFI information that includes MAC address and mobile network information to uniquely identify the devices and ensure that no unauthorized device acts on your behalf to prevent frauds.

COLLECTION OF INSTALLED APPLICATIONS

We collect a list of the installed applications’ metadata information which includes the application name, package name, installed time, updated time, version name, and version code of each installed application on your device to assess your creditworthiness and enrich your profile with pre-approved customized loan offers.

STORAGE

We require storage permission so that your KYC and other relevant documents can be securely downloaded and saved on your phone. You can then easily upload the correct KYC-related documents for faster loan application details filling and disbursal process. This ensures that you are provided with a seamless experience while using the application.

CAMERA

We require the camera information permission to provide you an easy/smooth experience and to enable you to click photos of your KYC documents along with other requisite documents and upload the same on the App during your loan application journey.

COLLECTION OF OTHER NON-PERSONAL INFORMATION

As a seller on Smitox, remember that any product or service you are offering must not violate any laws (international, national, state, or city laws) in the areas where Smitox has its presence.

Also, the products or services you list must comply with import or export laws of any nation we have a reach-in. If you are not sure about any of the laws, feel free to reach out, and we’ll guide you. If you “assume” that a product or service is legal in a city, locality, state, nation, or an international level and you prove to be wrong, Smitox will not be liable in any manner. A seller would be responsible and answerable for all such actions.

The product listing has to be done sincerely to avoid Smitox seller account deactivation. The listing must have

2. Proper or actual or real image of the product

3. Appropriate details of the product

4. Along with the proper pricing

If any seller’s product listing is found incomplete or improper then the seller account will be deactivated or the seller's product will not display on the Smitox platform.

Standard Forbidden Items :
Though Smitox is an entity in India, the B2B marketplace has reached many countries and continents. Hence, you are responsible, as a seller to not list any products/ services that are outlawed in any part of these nations or continents.

In addition to legally prohibited items, we have also banned the items that encourage illegal activities like lock pick tools, racially, religiously, and ethically depredatory items, items that are sexual in nature, items that are not classified as a physical product,s or service like digital currencies, any types of financial securities, giveaways, and any such items offered to collect user information.

Specific Outlawed Items:

Drugs
Any illegal drugs (like narcotics) or equipment needed to make or use them (drug precursor chemicals or carburetor pipes) or even to pack them (marijuana grow lights). Any media or content offering information on the production of such drugs is also banned.

Chemicals
Smitox prohibits any hazardous, flammable, or explosive chemicals including radioactive substances, poisonous chemicals, or toxic chemicals.

Ozone-depleting substances, harmful substances like products containing asbestos or even fireworks and firecrackers are also banned.

Weapons

Any ammunition and firearms are prohibited. Any content or media on the creation of arms, ammunition, or weapons (chemical, biological, and nuclear) are also banned. Even lookalike or replica of firearms or their components are not allowed. Any weapon that can potentially harm others like batons, stun guns, crossbows, or batons is also prohibited (including disguised knives or switchblade knives).

Law Enforcement, Government Or Military Issued Items
Clothing, badges, medals, awards, decorations, insignia, uniforms that resemble any such items offered by the law enforcement agencies, government, or the military are banned.

Only items that are sold as toys like toy badges or historical items (like badges) that are no longer used and Authorized general souvenirs are allowed.

The mass transit-related items like clothing, badges, medals, awards, decorations, insignia, uniforms pertaining to pilots, airport personnel, railway personnel, metro personnel, etc. must not be listed.

Safety manuals of buses, trains, airplanes, etc. can only be sold if they are obsolete.

Any kind of classified, official, internal, or non-public documents can’t be listed no matter when they were created.

Unless you can prove that you are a legally authorized dealer and intend to serve only legal authorities, you cannot list police equipment or any associated products.

Medical Drugs
Listing of prescription drugs, narcotics, and psychotropic drugs is prohibited. Products claiming to enhance sexual abilities, whether orally administered or indigested are strictly prohibited. Prescription veterinary drugs might or might not be listed (specific to the drug you are listing). Over the counter medications can be listed if you have & can offer production and sales permits to Smitox

Medical Devices
Any seller is not allowed to provide unauthorized medical devices that have been manufactured without the vital production and sales permits.

Adult Content Or Devices
Posting of any content or devices pertaining to pornography, sexual activity, rapes, or incest are strictly prohibited. Some kinds of sex toys can be listed but without any graphic images.

Crime-Oriented Equipment And Items
Any product that has to do with gaining access to unauthorized access like descramblers are not allowed. Any information that can lead to a crime like how to use hacking software is also prohibited. Devices designs to block or jam communications, spy equipment or devices used to intercept electronic communications are not allowed. Though hidden photographic items can be listed, they should not be used for illicit purposes. Unauthorized circumvention devices, skimmers, and black card readers are also not allowed.

Illegal Services
If a listing claims to provide a government service is found, it will be removed. Documents related to confidential government operations are also prohibited. Any devices used to create or forge government IDs or documents are not allowed.

No invoices, receipts, financial services, healthcare, or medical services should be listed. Any listing containing bulk email or spam messages is prohibited. Even job postings and non-business-to-business transactions are not allowed. Non-transferable items like airline tickets, lottery tickets, event tickets can’t be sold or listed.

Artifacts, Collections, Humans, And Animals
Artifacts, collections and precious metals, legal tender & stamps, gold, silver, and other precious metals (excluding jewelry), rough diamonds, human parts, human remains, protected fauna & flora, species, or animal parts, parts of mammals like whales and products made from animal skin or any equipment that can be used to harm animals illegally are not permitted

Replicas of coins and collectibles are permitted if they are marked with words like replica, reproduction, and copy. Human hair like wigs for commercial uses is permitted. Listing or sale of livestock, pets, and poultry can be listed for sales but not in wholesale.

Threats To National Security
Media, information, and publications that can aid terrorist organizations or threaten national security are strictly prohibited. Racially offensive postings and listings advocating, supporting, or promoting Nazism and Fascism and other extreme ideologies are prohibited as well.

Tobacco And Related Products
The listing of all tobacco products, including cigars, tobacco leaf, and cigarettes, is strictly prohibited. The listing of e-cigarettes & accessories and equipment for processing and producing tobacco products can be listed as per the laws of specific countries. For instance, Smitox members located in mainland China can only list equipment used for tobacco production and processing after they have acquired vital sales and production permits and can share the same with us.

Gambling Related Listings
Products that can be used for gambling are prohibited with the exception of equipment used for fun like playing cards.

Laws And Trade Restrictions
Products prohibited by trade restrictions, regulations, sanctions, and laws in any country, state, city, locality or internationally are prohibited on Smitox too.

Harmful, Used Or Refurbished Products
Products that can harm others like toys made by using lead, automotive airbags, and any explosive materials are prohibited. Listing refurbished laptops, mobile phones, computers, etc. is also prohibited. Used clothing can be listed (excluding undergarments) if they are thoroughly cleaned. Make sure that the postings don’t contain any inappropriate or extraneous descriptions. Used cosmetics listings are prohibited.

Tickets And Contracts
Before listing any kind of contracts or tickets, make sure you are doing so legally. For example, there are certain terms printed on an airline ticket that may restrict you from selling them on Smitox. You can resell event tickets if they are permitted by law and the terms listed on the tickets. Before listing any real estate items, make sure you are within the law limits. Listing of any kind of stolen illegally acquired or acquired without authorization is strictly prohibited.

IPR Related Listings
Listing that imitates an image, the signature or the name of another person or entity is prohibited unless you have proper authorization from the person or entity. The listing of unauthorized copies of video games, movies TV series, photographs, or software is prohibited too.

Counterfeit Products
Listings containing non-licensed replicas, counterfeits, and unauthorized items like designer clothes or sunglasses are prohibited. Products that have the name of a brand but are weren’t endorsed or originate from the brand are prohibited. Only postings of branded items that have a certificate of authorization issued by the brand owner are permitted.

Software Listings
Unauthorized listings of academic software are prohibited. You need to furnish a certificate of authorization if you want to list academic software. Bundled copies or OEM software products aren’t allowed on Smitox as they prohibit a purchaser from reselling it.

Adult Listings
Any adult subscription or chatting services or items containing nudity are prohibited on Smitox.

Degrees
Copies of original or fake degrees, diplomas, and other educational certifications is strictly prohibited on Smitox

Donations
Any listings requesting donations on behalf of a person or entity are strictly prohibited.

Please note that Smitox reserves the right to change the product listing policy at any point in time and it is the responsibility of the sellers to check it from time to time. Being unaware of a product listing policy will not be considered as an excuse when we take actions like removing a listing or banning a member (temporarily or permanently).

All decisions taken by Smitox with regard to product listing policy will be final and irrevocable. In case of any queries or concerns regarding a product listing or its removal, please contact the customer care team of Smitox, we’ll be happy to help you.

Note: Whatever rates you set for your product, it is assumed that you actually want to sell it at the mentioned price. Keep on checking your pricing and make sure you have set competitive prices. Smitox won't be responsible for product pricing even if the buyer is buying the product directly through the portal via clicking on the Buy Now button.

Smitox is an intermediary platform and will only be responsible to mediate the return request raised by buyers with the Seller. The resolution of issues or concerns raised by the buyer in return request shall be the sole responsibility of the Seller. Smitox shall not assume any liability for any failure on the part of the Seller to resolve buyer issues.

General return policy:

1. Products are returnable within 7 days from the date of delivery if it is received in a condition that is physically damaged, has missing parts or accessories, defective or different from the ordered product.

2. The return pickup time will be scheduled within 72 hours after the successful return initiates/accept the return request by us.

3. Refunds will be initiated after delivered to Seller. Seller notifies us of receipt of the return, as the case may be, a refund is issued to the original payment method (in case of pre-paid transactions) or the provided bank account.

4. Upload a clear picture of damaged/defective products that need to be returned.

5. The product is returned in the original condition as received (with brand’s/manufacturer's box, MRP tag intact, user manual, warranty card, and all the accessories therein).

6. Shipping cost refund will be eligible only if the total package is returned.

7. Upload a clear picture of the Cancel Cheque and the bank details/passbook for the smooth refund process.

8. Products may not be eligible for return in some cases, including cases of buyer's remorse such as incorrect model or color of the product ordered or incorrect product ordered.

The return can be done when there is the wrong color, Product not matching the description or specifications as ordered Warranty issues with respect to the Product, items are found to be missing (not due to logistics reasons), Issues related to the quality of the product, defective Product, size set, or packaging issues or if the product is damaged.

The responsibility of the logistics partner is to settle any of the below-mentioned concerns raised by the buyer. Contact the logistics service provider for resolving the below issues. It is hereby clarified that Smitox shall not assume any responsibility for the below points:

Any return request/ issues raised by the buyer for any of the following reasons:

a. Missing products/Goods or some items from the entire order placed found to be missing due to reasons attributable to the logistics provider;

b. Damage to the outer box delivered or Product/good damaged in transit; or

c. Any other logistics-related issues;

Depending on the category of Product timelines prescribed below, raise a return request accordingly:

a. Clothing: 7 days from the date of delivery of shipment

b. Fresh Products: 1 day from the date of delivery of shipment

c. Home and Kitchen: 7 days from the date of delivery of shipment

d. Food-FMCG : 3 days from the date of delivery of shipment

e. IT: 2 days from the date of delivery of shipment

f. Pharmaceutical: 7 days from the date of delivery of shipment

g. Phones: 2 days from the date of delivery of shipment

h. VAS: 2 days from the date of delivery of shipment

i. Accessories and Consumer Electronics: 2 days from the date of delivery of shipment

j. Footwear: 7 days from the date of delivery of shipment

k. Toys and Baby care: 7 days from the date of delivery of shipment

l. Stationary and Office Supply: 7 days from the date of delivery of the shipment

The return request may get rejected and the same will be communicated to the buyer. Due to the following reasons: (a) The buyer does not respond to the inquiry calls and/or calls made by us to procure missing documentation and information, or (b) supportive documents are insufficient, or Buyer is unable to provide sufficient proof in support of the claim, Buyer may raise a new return request within three (3) days from the date of such rejection.

At the time of raising a dispute, the Seller will be required to provide documents/ proof in support of the claim, which includes without limitation, images of the returned product(s)/ goods indicating the issue in the shipment received. The images need to clearly capture the following:

1. the Return ID;

2. AWB number of the shipment;

3. issue observed by Seller in the returned product;

4. brand name/ manufacturer’s name of the returned product; and/or

5. the IMEI number (in case the product is a mobile phone).

The Seller’s claim/ dispute will either be approved or rejected and the same will be communicated to the Seller.

Users (who use the platform) agree to be bound to any

1.Smitox will not be responsible or liable for the warranty or guarantee of any product sold on the Smitox platform.

2. Smitox has no concern with the expiry of the goods sold on the platform. If the seller sells expiry date products then Smitox will not be liable for that.

3. A product is returnable within the applicable return window if the buyer has received it in a condition that is

  • physically damaged,
  • has missing parts or accessories,
  • is defective, or
  • different from its description on the product detail page on Smitox.

4. Smitox will process a return only if: I. Smitox determine that the product was not damaged while in the buyer possession; II. The product is not different from what Smitox shipped to you; III. The buyer returns the product in its original condition (with the brand’s/manufacturer's box, MRP tag intact, user manual, warranty card, and all the accessories therein).

5. may not be eligible for a return in some cases, including cases of buyer's remorse such as incorrect model or color of the product ordered or incorrect product ordered.

6. The buyer cannot return products marked as "non-returnable" on the product detail page.

Note: If the buyer has received a non-returnable product in a damaged/defective condition, the buyer can within 7 days from the delivery of the product.

Selling on Smitox Fee Schedule
Smitox has an easy and transparent fee structure for sellers with no hidden charges. To sell on smitox.appstractinnovations.com, sellers pay Smitox Fees. Smitox will charge the fee only when the seller makes a sale on smitox.appstractinnovations.com. Smitox Fees

The Smitox fee ranges from 5% to 20% on the transaction value. The percentage of the Smitox fee charges varies from category to category and is paid by the seller on every order. Smitox asks for a Smitox fee to take care of the business deal and helps in fighting scammers and bad suppliers.

For all orders, a percentage of the total sales price that is paid by the buyer (including the item price or charges charged by the seller) is deducted as a Smitox fee from that amount.

Note:
The sales amount will be given to the seller what the buyer has given. The Smitox fee will get deduct and the remaining amount will be sent to the seller.

Note:
All claims for incorrect or wrong Smitox fees must be notified or reported to Smitox in writing within 15 working days of the order being shipped. If no such claim is filed or registered within the prescribed timeline or deadline, the Smitox fee charged will be deemed or considered correct and accepted by the sellers. No claim filed after the expiry of this timeline will be entertained and Smitox will not be liable or responsible for any claims brought / damages suffered by the sellers. Smitox Cancellation charge

Seller will be charged 100% of the Smitox fee (if he canceled on or before the pickup) OR 150% of the Smitox fee (if cancellation is done after 3 attempts of pickup) of the value of items in an order as a Cancellation Charge for seller-fulfilled orders that are canceled under the following situations:

  • 1. The order is canceled by the seller for any reason other than the buyer’s request. (Only cancellations requested by buyers through the smitox.appstractinnovations.com website are considered buyer-requested cancellations and will be exempt or free from the Cancellation Charge.)
  • 2. The order is canceled automatically by Smitox because the seller has not shipped and confirmed the shipping of the order within 3 days of the order placed date.
  • 3. A Smitox fee is not charged to the seller only if the order is canceled by the buyer for any valid reasons.

Note: All fees are exclusive of 18% Goods and Services Tax (GST). To ensure that the seller is charged the correct Smitox fee, the seller will need to categorize the items of the order as precisely as possible when the seller lists them on the website. Smitox Payment Process terms

The sales amount will be given to the seller which is taken by Smitox from the buyer on behalf of the seller. The Smitox fee will get deduct and the remaining amount will be sent to the seller. Some percentage of the amount may be saved/ deposited or maintained with Smitox. The saved amount will be released later on. This is done to help buyers asking for a return or any such issues.

The process of releasing payment will follow a seven days schedule from the date of delivery. Every Saturday the delivered order sale amount generated from Saturday to Friday will be released in the seller's account linked with Smitox. For example, if the order is delivered on Tuesday then the sales amount will be released the next Saturday (not of the same week Saturday). The payment cycle takes at least 7 days to complete.

The seller will be charged cancelation charges, RVP, and other charges (in case of wrong product category listing and other issues).

The seller has to use the Smitox tape to pack the order and If he/she fails to do so a fine of INR 100/- will be imposed on them.

The return policy will be applicable to the registered Smitox sellers who have received return request/s for the products offered for sale by the seller and ordered by the buyers using the Smitox platform.

This policy will have applicability only to registered sellers who have received return requests on the Smitox platform. It is advised to the seller to go through the Smitox return policy for the Buyers' consistent experience on the Smitox platform.

  • 1. The seller has to follow and respond to the 7 days return policy:
  • 2. RVP (Reverse Shipment):- If there is a damaged product or a wrong product has been dispatched, in such issues, a transaction fee as per the category will be charged. While transportation if anything is damaged then the logistic service provider/ Smitox will look after that (depends on the condition of the goods). If it is done by Smitox Express, the request will come under the dispute team and the issue will be resolved within 7 working days. In the case of a 3rd party logistic or channel partner then it will resolve within 14 working days.
  • 3. If the goods are missing or lost then only the seller, who took insurance will get a refund. Smitox will not be responsible or liable if the insurance of the goods is not taken by the seller.

Smitox Process upon receipt of return request

The return request raised by the buyer will internally scrutinize and take action according to the Smitox Policy. The seller will be notified about Smitox's action on such a return request on the platform.

Based on Smitox's internal scrutiny of a return request, Smitox may in the sole discretion, reserve a right to settle the order amount for the product for which Return Request has been placed by the buyer, without returning the product to the seller. Delivery of returned product to the seller

Smitox will endeavor to make the first attempt to deliver the returned product to the seller within 20 days from the date of receipt of the returned product (except for products under the Food-FMCG category for which within two to five (2-5) days is applicable) from the buyer. For any delay in making the first attempt to deliver the Reverse Shipment beyond the said timeline due to reasons solely attributable to Smitox, Smitox will communicate such delay to the seller within a reasonable time. Unavoidable circumstances or natural calamity, timelines will be extended. The seller will be able to track the Reverse Shipment (defined below) on the platform. Seller is bound to accept the delivery of Reverse Shipment and sign the proof of delivery given by Smitox logistics or partner.

The returned product will be delivered to the seller from where the shipment was picked up in the same condition in which it is received by Smitox directly or 3PL service providers.

It is hereby clarified that Smitox will not be responsible or liable to re-package the returned product and the same will be delivered to the seller on an as-is’ basis.

If the seller or its representative is unavailable or the delivery location to be closed then the Smitox field executive will make a maximum of two (2) more attempts to deliver the Reverse Shipment to the designated delivery location. Smitox will endeavor to attempt delivery within the next forty-eight (48) hours from the last delivery attempt. The Smitox returns team will contact the seller to arrange for delivery of the Reverse Shipment.

However, if despite Smitox''s reasonable efforts, unable to deliver the Reverse Shipment to the seller in the third attempt, the Reverse Shipment will be transferred to the Smitox liquidation hub for liquidation. Smitox will deduct and adjust the value of the Reverse Shipment (that has already been transferred to the seller for the said Reverse Shipment) from seller sale proceeds that are collected by Smitox on the seller's behalf from the Buyer(s) or any other amounts that Smitox is required to pay the seller. Seller agrees that the seller will not be entitled to receive any money or amount that Smitox may receive from the liquidation of such Reverse Shipment.

At the time of delivery of the Reverse Shipment, the Smitox field executive will open the Reverse Shipment at the seller location and the seller is bound to accept such shipment in an open condition. The seller agrees to allow the Smitox field executive to take photos, videos, etc. of the opened Reverse Shipment.

Seller acknowledges and undertakes that such photos, videos, etc. and/or remarks by Smitox field executive with respect to the Reverse Shipment (“Evidence”) will be used by Smitox at the time of settling disputes (if any) that may be raised by the seller with respect to the Reverse Shipment. Smitox may ask the seller to provide additional documents in support of the seller dispute as per the terms of this Policy.

At the time of delivery of the Reverse Shipment to the seller or any of the seller representatives, the Smitox field executive will require the seller to acknowledge the delivery of the same by signing on the (“POD”) proof of delivery document. Seller is advised to carefully sign on the POD and clearly call out the damage or tampering to the packaging if any and immediately report the same to Smitox within seventy-two (72) hours from the receipt of delivery of Reverse Shipment by choosing the ‘Disputes’ option on the Returns Page on the Platform as per Section below.

  • 1. At the time of receiving the Reverse Shipment, please make a note of the following points: Seller will not detain Smitox field executive for any reason whatsoever
  • 2. The seller will clearly mention any tampering, pilferage, or damage to the Reverse Shipment on POD at the time of receiving the Reverse Shipment from Smitox and immediately raise seller concerns on the Smitox Platform.

Refusal to accept delivery of Reverse Shipment

The seller is bound to accept the delivery of Reverse Shipment. However, if the seller refuses to accept delivery of the Reverse Shipment, Smitox will make a maximum of one (1) more attempts to deliver the Reverse Shipment to the seller within a reasonable time. Smitox's return team will contact the seller to arrange for delivery of the Reverse Shipment. However, if despite reasonable efforts from Smitox end to deliver the Reverse Shipment to the seller, the seller refuses to take delivery of the Reverse Shipment, the seller agrees and acknowledge that Smitox will be entitled to move the Reverse Shipment to the Smitox liquidation hub and liquidate or dispose of off such Reverse Shipment in any manner as Smitox may deem fit in Smitox sole discretion. Smitox will deduct and adjust the value of the Reverse Shipment (that has already been transferred to the seller for the said Reverse Shipment) from the seller sale proceeds that are collected by Smitox on the seller behalf from the Buyer(s) or any other amounts that Smitox are required to pay the seller. Smitox will not entertain any claims brought by the seller for such unaccepted / refused Reverse Shipment and the seller agrees that the seller will not be entitled to receive any money or amount that Smitox may receive from the liquidation of such Reverse Shipment.

If it is found that the seller has misbehaved with the Smitox customer support team or forcefully detained or misbehaved with Smitox field executive, Smitox reserve the right to not deliver the Reverse Shipment and deduct & adjust the value of the Reverse Shipment from seller sale proceeds. Smitox further reserves the right to take appropriate action against the seller as per applicable laws.

Smitox may accept delivery of Reverse Shipment in certain exceptional cases, in case of products under the Food/ FMCG category, if Smitox may deem fit in Smitox's sole discretion.

Raising a Dispute

Seller may raise a dispute through the Returns Page on Platform within seventy-two (72) hours from receipt of delivery of the Reverse Shipment to the seller, failing which the Reverse Shipment will be deemed as accepted by the seller without any damage or fault.

Seller may raise a dispute for any one of the following reasons using the Platform:

  • 1. Reverse Shipment as the outer box is in a visibly damaged condition or tampered
  • 2. Products received are wrong
  • 3. The difference in the quantity
  • 4. If the Reverse Shipment is not delivered to the seller but marked “delivered” on the Platform
  • 5. Mismatch/non-alignment with the approved refund amount
  • 6. Sellers will also have a right to raise a dispute in cases where Smitox chooses to settle the amount with the Buyer for the returned product without sending the returned product to the seller.

Upon receipt of seller complaint or dispute on the Platform, Smitox returns dispute team will get in touch with the seller to resolve seller concerns or disputes in accordance with Smitox return policies as may be amended from time to time. seller agrees to co-operate with Smitox while investigating the claim or dispute raised by seller and provide Smitox photographs and/or videos of Reverse Shipment (internal and outer box), and such other documents/ proof or information which Smitox may require to investigate into the issue or concern raised by the seller. The seller further agrees that the dispute will be settled by Smitox. Smitox's decision with respect to the investigation will be final and binding on the seller based on the evidence collected by Smitox. The seller agrees that Smitox's decision with respect to the investigation and seller dispute will be final and binding on the seller.

Smitox may require certain documents/ proof/ information from the seller end in support of the seller claim, at the time of raising a dispute or post submission of seller dispute. These documents/proof in support of seller claim may include without limitation:

Photos or images of the returned product(s) indicating the issue in the Reverse Shipment delivered. The images need to capture the following:

  • 1.The Return ID
  • 2.AWB number of the Reverse Shipment
  • 3.Packed Reverse Shipment
  • 4.Issue observed by the seller in the returned product
  • 5.Damages to the returned product
  • 6.Brand name/ manufacturer’s name of the returned product; and/or
  • 7.The IMEI ( International Mobile Equipment Identity) number (in case the product is a mobile phone).

Dispute Settlement Process
Upon receipt of the seller dispute and necessary documentation in support of the seller claim, Smitox will investigate internally and endeavor to resolve the seller dispute within five (5) days of receipt of the dispute. Based on the documentation provided by the seller, the dispute may be resolved either: Against seller, if it is concluded by Smitox that:

Evidence collected by Smitox and documentation, proof, and information provided by the seller in support of seller claim do not match;

document/ proof provided by the seller in support of seller claim is insufficient; or

The seller does not respond to the inquiry calls and/or calls made by Smitox to procure missing documentation, proof, and information in support of the seller's claim from the seller's end; in such cases, the seller's dispute will be settled against the seller.

In such cases, within forty-eight (48) hours of resolution of the seller dispute, Smitox will deduct and adjust the value of the returned product (that has already been transferred to the seller for the said returned product)from seller sale proceeds that are collected by Smitox on seller behalf from the Buyer(s) or any other amounts that Smitox are required to pay seller; or

In seller favor, if it is concluded by Smitox that:
Document/ proof/ information submitted by the seller along with seller disputes are sufficient and justify the seller claim and match with evidence collected by Smitox, then Smitox will approve the seller dispute. If the dispute is settled in the seller favor, Smitox will not make any deductions or adjustments for the value of the returned product (that has already been transferred to the seller for the said returned product) from seller sale proceeds that are collected by Smitox on the seller behalf from the Buyer(s) or any other amounts that Smitox are required to pay to the seller.

Returns dispute resolution is a mechanism of seller security/protection and is subjected to guidelines of fair use by sellers. If Smitox in Smitox’s opinion becomes suspicious or becomes aware of any misuse of this Policy or the Platform by the seller, Smitox may notify the seller of a change in the applicability of Smitox dispute resolution mechanism.

Buyer may request returns for most items purchased from sellers listed on Smitox that are within the return window, within 7 days of delivered date except those that are explicitly identified as not returnable on the product detail page and/or Smitox Returns policy.

  • I.Physically damaged,
  • II. has missing parts or accessories,
  • III. defective or different from the ordered product.

Smitox will process a return only if:

  • I.Smitox determine that the product was not damaged while in the buyer possession;
  • II. The product is not different from what Smitox shipped to you;
  • III. The buyer returns the product in its original condition (with the brand’s/manufacturer's box, MRP tag intact, user manual, warranty card, and all the accessories therein).
  • Following are the return guidelines:

    • I.The buyer who wishes to return must be eligible for return.
    • II.Buyers' complete address with Pincode must be available.
    • III.It is determined that the product was not damaged while in your possession.
    • IV.The product is not different from what was shipped to you.
    • V.The product is returned in original condition (with brand’s / Manufacturer box, MRP tag intact, user manual, warranty card, and all the accessories therein).
    • VI.Refunds will be initiated after delivered to Seller. Seller notifies us of receipt of the return, as the case may be, a refund is issued to the original payment method (in case of pre-paid transactions) or the provided bank account.

    The buyer needs to capture and submit videos and photos of the returned product within 48 hours.

    Products may not be eligible for a return in some cases, including cases of buyer's remorse such as incorrect model or color of the product ordered or incorrect product order.

    The buyer cannot return products marked as "non-returnable" on the product detail page.

    Note: If the buyer has received a non-returnable product in a damaged/defective condition, the buyer can contact customer support within 7 days from the delivery of the product.
